Placing an order

How do I pay for my orders?
- All orders must be paid through credit cards using our secure payment gateway in the app. Swyftr is a contactless portal and we do not accept cash payments on behalf of our vendors.

At what point do I get charged?
- The credit card registered will be charged for the complete order only once the vendor accepts your order. You will not be charged while the order is pending or if cancelled prior.

My app indicates the order is yet to be accepted by the vendor
- Vendors have to accept the orders placed within 10 minutes.
- Should the order delay beyond this, please contact our customer support center on 0721 600 600 or click the helpdesk icon on your order tracking screen.

My vendor rejected my order
- This usually indicates that one or more items are not in stock.

The vendor has accepted my order, my card was charged but an item was stocked out
- In this circumstance, the vendor may have missed updating their daily stock accurately and will cancel the complete order and a refund will be provided within 5 working days.
- Another order can be placed without the stocked out item.

My app indicates the order is still under packing stage and not picked up.
- Swyftr may have large order volumes that can impact delivery times.
- Should the delay be longer than 30 minutes, please contact 0721 600 600 or click the helpdesk icon on your order tracking screen.

Can I order from multiple vendors?
- NO. Swyftr is an online market place similar to a shopping mall. Each order is specific to a vendor.

Can I place multiple orders concurrently?
- YES. Upon placement of an order with a vendor through the Swyftr portal you may place another separate order with any other vendor of your choosing.

Does the delivery fee vary by distance?
- The delivery fees are calculated depending on the distance between the vendor and the item delivery points. You will be quoted a fixed fee prior to placing your order.

Can I track my order?
- YES. Swyftr provides last mile tracking through every stage from order placement to delivery to drop off.

Can I track my order?

- Where multiple orders have been placed concurrently, all orders can be tracked via the swyftr app.

Can I cancel an order after placement?
- The order can be cancelled through the app until the vendor accepts the order.
- IF the vendor has accepted the order, the order cannot be cancelled through the app and you will have to contact our hotline on 0721 600 600 or through the helpdesk icon on order tracking screen.
- Orders cannot be cancelled after our delivery partners have collected the packages from the vendor and are en route to the delivery destination.
- Once an order has been cancelled successfully within the cancellation window, a refund can be provided within 5 working days.

How long will it take for an order to be delivered?
- Swyftr is an on demand service provider and aims to fulfill all orders within the given ETA via the app, within the day. Typically this can range from 30 mins to 3 hours based on distance and jobs in hand

Can I schedule an order?
- Currently this is not possible as Swyftr is purely an on demand service provider.




I have an issue with my delivery

My order is late?
- Swyftr may have large order volumes that can impact delivery times.
- Should the delay be longer than ETA, please contact 0721 600 600 or click the helpdesk icon on your order tracking screen

Can I contact my assigned delivery partner?
- Yes. Once your delivery partner has collected your order and is en route you are able to connect with him/her through the link on your order tracking screen.

I was not happy with my delivery partner
- We value all customer feedback and aim to ensure all partners abide by our high stands of service and etiquette. Please send us an email with your concerns to info@swyftr.com.

The delivery partner left without handing over the package
- If the authorised person to collect the package is not available, our delivery partners will attempt to call you on the mobile number provided. Failing which, our delivery partners will wait for a maximum of 10 minutes at the drop off location. This is monitored through GPS enablement in our platform.
- Should they not abide by this policy, please contact our hotline 0721 600 600 or click the helpdesk icon on your order tracking screen.

I will not be at the drop off location when delivery arrives?
- Our delivery partners will wait for a maximum of 10 minutes at drop off location. This is monitored through GPS enablement in our platform.
- It is the responsibility of the customer to ensure you or someone else you nominate is available at the drop off location to collect the order.
- The name of the customer or the order number must be provided to the delivery partner prior to handoff to complete the order.




Issue with the items received

The items I have received are not what I ordered and paid for?
- Please contact our hotline on 0721 600 600 or click the helpdesk icon on your order tracking screen.

The item(s) i received are broken / and or damaged in delivery

- The customer will be provided refunds if the damage was caused by the vendor or Swyftr delivery partner.
- Swyftr would coordinate collection of damaged items if required and refund would be authorised at point of collection.

The item(s) I ordered stopped working after receipt.
- Swyftr is a portal for order placement and is responsible for the delivery.
- Actual purchases are between the customer and the specific vendor.
- For any issues, which are not related to goods damaged in transit, please contact the vendor directly.

I no longer require the item, and wish to return it.
- Swyftr is a portal for order placement and is responsible for the delivery.

I have an issue with the Payment

I have been wrongly charged for my order
- Please contact 0721 600 600 or click the helpdesk icon on your order tracking screen, and any overcharge will be refunded within 5 working days.

The payment isn’t going through for my order
- Please contact 0721 600 600 or click the helpdesk icon on your order tracking screen to escalate any technical glitches.

I need to add another card to my account
- You may do so using the Swyftr app under settings.




How do I manage my account?

How do i change my registered mobile number?
- You may change your registered mobile number through the Swyftr mobile app
- Once signed in, click on Account and select option to change mobile number

Can i change my registered email address?
- You cannot change your email address at this stage through the app. Please contact Swyftr helpdesk on 0721 600 600

I didn’t receive my OTP for registration?
- OTP should take upto 5 minutes.
- Please recheck whether you are using the registered mobile number.
- Please check whether you have mobile data coverage.
- Failing the above, please contact 0721 600 600 to escalate any technical glitches.




Data Privacy

Will my personal information be shared with third parties?
- No. Swyftr believes in the fundamental rights of privacy and will not disclose any private information of our users.
- This includes but is not limited to name, NIC, email addresses, and mobile numbers.

Is my credit card information secure?
- Yes. Swyftr believes in the fundamental rights of privacy and will not store credit card information of our users.

Will my order history be confidential?
- Yes. It is only accessible to our users.
- Swyftr customer support can access order history on request by a customer.







Terms and Conditions

By using Swyftr, you agree to these conditions. Please read them carefully.

We are a mobile application based online market place connecting customers with our vendor partners in real time for On Demand purchasing. We undertake to collect the purchased goods from the vendor partners and deliver to the customers in as short a timeframe as possible, while providing last mile status tracking. In addition to our terms and conditions, specific vendors would have their own policies which apply to customers. It is the responsibility of the customer to check with vendors on specific policies.

PRIVACY

All personal data held by Swyftr is confidential and not shared with third parties unless requested under legal warrant. Personal details include but are not limited to name, NIC number, mobile number and email address. Credit Card and payment details saved using Swyftr App is not saved by Swyftr and is held securely by our payment gateway partner. Details of customer order history will be accessible to the specific customer, while vendor partners would only have access to customer order history specific to their Swyftr stores(s).

ELECTRONIC COMMUNICATIONS

When you use Swyftr, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this platform and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included in or made available through Swyftr, such as text, graphics, logos, button icons, images, data compilations, and software is the property of Swyftr or its content suppliers and protected by international copyright laws. The compilation of all content included in or made available through any Swyftr is the exclusive property of Swyftr and protected by international copyright laws.

TRADEMARKS

Swyftr's trademarks may not be used in connection with any product or service that is Swyftrs, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Swyftr. All other trademarks not owned by Swyftr that appear on the platform are the property of their respective owners, who may or may not be affiliated with, Swyftr.

LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees Swyftr grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the services on platform. This license does not include any resale or commercial use of any Swyftr service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Swyftr Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by Swyftr or its licensors, suppliers, publishers, rightsholders, or other content providers. No Swyftr service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Swyftr. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Swyftr without express written consent. You may not use any meta tags or any other "hidden text" utilizing Swyftr's name or trademarks without the express written consent of Swyftr. You may use the Swyftr services only as permitted by law. The licenses granted by Swyftr terminate if you do not comply with these Conditions of Use or any Service Terms.

YOUR ACCOUNT

You need your own Swyftr account to use Swyftr services, and you are required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Swyftr does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use Swyftr only with involvement of a parent or guardian. Alcohol listings on Swyftr are intended for adults. Swyftr reserves the right to refuse service, terminate accounts, terminate your rights to use Swyftr, remove or edit content, or cancel orders in its sole discretion.

INTELLECTUAL PROPERTY COMPLAINTS

Swyftr respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please notify us immediately on info@swyftr.com

RISK OF LOSS

All purchases of physical items from Swyftr are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

RETURNS, REFUNDS AND TITLE

Swyftr will only process refunds where an order is cancelled by the vendor after accepting order, where the order is canceled by the customer before dispatch by vendor, where items received are incorrect or damaged. Outside of these circumstances refunds may be processed purely at our discretion.

Any purchasing placed on Swyftr platform is a trade between the customer and the relevant store. Swyftr is liable for facilitating payment and for delivery. Swyftr is liable for goods damaged in transit. In all other circumstances Swyftr bares no liability but shall process and facilitate the refund between vendor and customer in the circumstances detailed above.

Swyftr does not take title to returned items until the item is received by a Swyftr delivery partner os arrives at vendor partner, unless expressly agreed by Swyftr at time of initiating retun. At our discretion, a refund may be issued without requiring a return. In this situation, Swyftr does not take title to the refunded item.

PRODUCT DESCRIPTIONS

Swyftr attempts to be as accurate as possible. However, Swyftr does not warrant that product descriptions or other content of any Vendor store is accurate, complete, reliable, current, or error-free. Product descriptions are the Vendors responsibility and Swyftr shall take prompt action against vendors where customers notify us of any discrepancies.

PRICING

"Selling Price" means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. Certain products may have a "Was Price" displayed, which is determined using recent price history of the product on Swyftr. You as the customer will be charged the Selling Price listed at time of purchase.

PAYMENT PROCESSING

Swyftr is a contactless, card-based retail market place. Cutomers are required to enter their payment details which are securely stored by our payment gateway service provider. You will only be charged at the point a vendor accepts your order. Swyftr is not liable for any loss or damage caused due to actions or inactionsof our Payment gateway partners. Swyftr would seek recovery of damages on the customers behalf from the payment gateway partners

APP PERMISSIONS

When you use Swyftr, you may grant certain permissions to us for your device. Most mobile devices provide you with information about these permissions. It is the customers duty to enable notifications into receive status updates related to an ongoing order.

OTHER BUSINESSES

Third party vendor partners operate stores on Swyftr to sell their product lines. In addition, we may provide links to the sites of affiliated companies and certain other businesses. If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from Swyftr. We are not responsible for examining or evaluating, and we do not warrant, the offerings of any of these businesses or individuals (including the content of their Web sites). Swyftr does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

SWYFTR AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH SWYFTR ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. SWYFTR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF SWYFTR, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH SWYFTR, UNLESS OTHERWISE SPECIFIED IN WRITING. DISPUTES

Any dispute or claim relating in any way to your use of Swyftr, or to any products or services sold and delivered through Swyftr will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

APPLICABLE LAW

By using Swyftr, you agree the purchase and conditions of use to be governed and construed by the laws of Sri Lanka.

ADDITIONAL SWYFTR SOFTWARE TERMS

The following terms (“Software Terms”) apply to any software (including any updates or upgrades to the software) and any related documentation we make available to you in connection with Swyftr

USE OF THE SWYFTR PLATFORM

You may use Swyftr solely for purposes of enabling you to use the services as provided by Swyftr, and as permitted by these Conditions of Use and any Service Terms. You may not incorporate any portion of the Swyftr Software into other programs or compile any portion of it in combination with other programs, or otherwise copy (except to exercise rights granted in this section), modify, create derivative works of, distribute, assign any rights to, or license the Swyftr Software in whole or in part. All software used in Swyftr platform is the property of Swyftr or its software suppliers and is protected by Sri Lankan and international copyright laws.

USE OF THIRD PARTY SERVICES

When you use Swyftr, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile software provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

NO REVERSE ENGINEERING

You may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with the Swyftr platform, whether in whole or in part.

UPDATES

We may offer automatic or manual updates to SWYFTR at any time and without notice to you.

Please note also that providing detailed and accurate information at the outset will facilitate efficient processing of your request. That information will include, for example, e-mail and/or credit card number used to make purchases for retail purchase information; the name, e-mail, and physical address of a seller for seller information; and complete time stamps.

NOTICE AND PROCEDURE FOR MAKING CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT

If you believe that your intellectual property rights have been infringed, please submit your complaint to our email info@Swyftr.com.

We respond quickly to the concerns of rights owners about any alleged infringement, and we terminate repeat infringers in appropriate circumstances.

Written claims concerning copyright infringement must include the following information:

A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;

A description of the copyrighted work that you claim has been infringed upon;

A description of where the material that you claim is infringing is located on the site;

Your address, telephone number, and e-mail address;

A statement by you that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law; and

A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
